Terms & Conditions and Agency Fees – Hotel/Holiday Nanny or Babysitter

INTERPRETATION: Any reference to “The Agency” is a reference to The Parent and Child Nanny Agency and any reference to “The Client” is a reference to the persons who have requested The Parent and Child Nanny Agency to introduce staff for employment by that person or persons on a temporary basis. “The Service” refers to the process of introducing a childcare professional to a client for a specific date and time. Any reference to “The Hotel Nanny or Babysitter” is a reference to any childcare professional introduced by The Parent and Child Nanny Agency to provide childcare in a Hotel, Airbnb, B&B, holiday rental, caravan, or similar Holiday or temporary Accommodation

1. Contract

1.1 The engagement or use of service by The Client is an acceptance by The Client of these terms and conditions and of The Agency fees and payment thereof as set out by The Agency. No variation of these terms is valid unless agreed in writing by both The Client and The Agency.

1.2 These terms and conditions shall represent a legally binding contract between The Client and The Agency.

1.3 The verbal or written instruction is given by The Client to The Agency in order to deliver childcare by The Hotel Nanny or Babysitter as per the instructions of The Client.

2. Fees and Refunds

2.1 An engagement takes place when The Client has completed The Agency booking form and related booking payment.

2.2 The Agency will introduce a  Hotel Nanny or Babysitter to The Client’s specified timings, as per the completed booking form.

2.3 A booking fee of £40 is payable by The Client to The Agency for the service of introducing a Hotel Nanny or Hotel Babysitter.

2.4 The Hotel Childcare service is complete once the following have been applied:
a. The Client has completed a booking form
b. The Client has paid a booking fee of £40
c. The Agency have confirmed the booking and provided full details of the Hotel Nanny or Hotel Babysitter booked
d. The Hotel Nanny or Hotel Babysitter has introduced themselves to The Client.

2.5 If The Agency is unable to fulfil the Hotel Childcare requirement up until 3 hours prior to the booking start time, the booking fee will be refunded in full within 5 working days.

2.6 The Agency will inform The Client at least 24 hours prior to The Booking Date of the availability of a Hotel Nanny or Babysitter. If the search is performed within 24 hours (this includes bookings made on a Friday after 1 pm for Saturday, Sunday, or Monday) The Agency will keep searching until 3 hours prior to the booking start time to take into account the weekend closure.

2.7 If The Agency is unable to fulfil the requirement and the client requests the booking is transferred to another day that can be fulfilled, The Agency booking fee will be transferred to the new booking date and the client will be invoiced for any subsequent booking service fees.

2.8 Once The Agency has confirmed the availability of a Hotel Nanny or Hotel Babysitter, if The Client then cancels the booking, there is no refund of agency booking service fees and one hour will be charged by your hotel nanny or babysitter if cancelled with less than 24 hours notice and 4 hours charged if cancelled with less than 12 hours notice.

2.9 The Client agrees to pay the hourly rate and in some instances, additional travel costs negotiated with The Agency directly to the Hotel Nanny or Babysitter either on the day of the booking or seven days in advance of the booking.

2.10 The Agency booking service fee is £40 per Hotel Babysitter per booking and £40 per Hotel Nanny per booking. The Hotel Nanny or Babysitter charges £15.00 per hour (£20.00 per hour for bank/public holidays) for a minimum booking period of 4 hours. If the booking requested is less than 4 hours you will still need to pay your nanny the minimum booking charge There is a surcharge of £1.00 per hour for booking between 12 am and 6 am (unless an overnight booking has been agreed). A fuel charge of approx £5.00 each way will be charged by The Hotel Nanny or Hotel Babysitter for bookings in rural locations, or, where there is a shortage of local nannies. There is a one-day agency surcharge for last-minute and urgent bookings. The full amount is payable to the nanny regardless of whether the booking is cut short by the client due to an early return time.

3. Cancellations & Postponements

3.1 The Agency reserves the right to cancel the booking at any time. If The Agency cancels a confirmed booking, the related agency booking fee will be reimbursed in full within 5 working days.

3.2 If The Client cancels the confirmed booking for any reason including and not restricted to adverse economic, social, and environmental changes, The Agency booking deposit will not be refunded.

3.3 If The Client postpones the booking for any reason, the initial booking will be cancelled, no refund will be issued and a new agency booking fee will be payable.

3.4 If the Hotel Nanny or Babysitter cancels the booking a replacement will be provided. If a replacement is not available a full refund will be issued. A refund will not be issued where:

a/ There is an un-resolvable dispute between the Hotel Nanny or Babysitter and The Client regarding the terms of the booking.
b/ The Hotel Nanny or Babysitter has cancelled due to adverse economic, social, and environmental changes.
c/ Both The Hotel Nanny or Babysitter and The Client agrees to cancel the booking.

3.5 If The Client has booked and partially paid for Hotel Nanny or Babysitting service, the booking will automatically be cancelled if the balance is not paid in full at least 7 days prior to the booking date and no refund of fees already paid will be reimbursed.

3.6 Please use this form in all cases to inform us of a need for a replacement, cancellation or revision of your booking. FORM

 4. General

4.1 The Agency has a minimum booking requirement of 4 hours per booking unless by prior agreement.

4.2 The Hotel Nanny or Babysitter is required to work in accordance with The Agency and Ofsted’s minimum staffing ratios and as such reserve the right to refuse to care for additional children on the day, if this breaches the ratios.

4.3 The Agency endeavours to provide The Client with only the most suitable Hotel Nanny and Babysitter. The Agency does not accept any liability for any kind of inconvenience, loss, or damage however arising and whether caused directly or indirectly by The Hotel Nanny or Babysitter.

4.4 Hotel Babysitting bookings are for bookings after 6 pm. Hotel Nanny Bookings are for Bookings commencing after 6 am for any period of time up to 16 hours. Bookings longer than 16 hours will be subject to an additional booking fee. Overnight bookings between 2 am and 6 am will be subject to an additional booking fee.

4.5 The Hotel Nanny or Babysitter works on a self-employed basis and holds their own public liability insurance.

4.6 It is the responsibility of The Client to inform The Agency in writing, at the time of booking if there are any special needs/requirements that the child/children may have/require so that The Agency can make the appropriate arrangements with The Hotel Nanny or Babysitter involved. This is specifically important in the areas of health and or diet.

4.7 Once the booking is complete, The Client must inform the Agency if any further working relationship is to be established between The Client and The Hotel Nanny or Babysitter. If The Client does not inform The Agency of such a relationship, The Agency will charge a placement fee plus an additional 10% charge if express prior permission has not been gained in writing from The Agency.

5. Confidentiality

5.1 All communication, whether written or verbal shall remain confidential between The Agency, The Client, and The Hotel Nanny or Babysitter.

These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales.
The Agency reserve the right to amend these terms and conditions without prior notice.

Update: July 2020 (Covid-19)

If you have booked a Hotel Nanny or Babysitter and are displaying signs of Covid-19, please cancel your booking immediately. If your Hotel Nanny or Babysitter displays signs of Covid-19 as per NHS guidance, they will cancel the booking immediately.

You can rest assured your Hotel Nanny or Babysitter will be taking measures to ensure good hygiene, mask-wearing where necessary, social distancing, regular hand washing and hand sanitising on arrival. Please do the same to protect our nannies.

Update: March 2022 (Covid-19)

Our Hotel Nannies and babysitters will test using a lateral flow test when they have been exposed to Coronavirus. The booking will be cancelled if the test is positive or if the Hotel Nanny or Babysitter shows early signs of Covid-19.

We are following government guidance at all times.
