Terms & Conditions and Agency Fees – Temporary Childcare

INTERPRETATION: Any reference to “The Agency” is a reference to The Parent and Child Nanny Agency and any reference to “The Client” is a reference to the persons who have requested The Parent and Child Nanny Agency to introduce to them staff for employment by that person or persons on a temporary basis. Any reference to “The Nanny/Nannies” is a reference to any childcare professional introduced by The Parent and Child Nanny Agency.

1. Contract

1.1 The engagement or use of service by The Client is an acceptance by The Client of these terms and conditions and of The Agency fees and payment thereof as set out by The Agency. No variation of these terms is valid unless agreed in writing by both The Client and The Agency.

1.2 These terms and conditions shall represent a legally binding contract between The Client and The Agency.

1.3 The verbal or written instruction is given by The Client to The Agency in order to deliver temporary childcare by The Nanny/Nannies as per the instructions of The Client.

2. Fees and Refunds

2.1 An engagement takes place when The Client has completed The Agency booking form and related booking deposit payment.

2.2 The Agency will introduce the number of Nannies requested to The Client’s specified timings, as per the completed booking form.

2.3 A non-refundable booking fee is payable to secure the booking with The Agency.

2.4 The Client agrees to pay an hourly rate negotiated with The Agency directly to The Nanny/Nannies either on the day of the booking or in advance of the booking.

2.5 Final confirmation of the number of children is required from The Client no later than four weeks prior to the booking date. Any increase in numbers may require further Nanny Introductions which will be charged for immediately. Any decrease in numbers will not be refunded.

2.6 The Client is solely responsible for paying the agreed wages of The Nanny/Nannies introduced to the client.

2.7 A refund of 50% of any payments received additional to the Agency booking deposit will be refunded subject to The Client providing at least 4 weeks’ notice of cancellation in writing.

3. Cancellations & Postponements

3.1 The Agency reserves the right to cancel the booking at any time. If The Agency cancels a confirmed booking, the related agency booking fee will be reimbursed in full.

3.2 If The Client cancels the booking for any reason including and not restricted to adverse economic, social and environmental changes, The Agency booking deposit will not be refunded.

3.3 If The Client postpones the booking for any reason, the initial booking will be cancelled, no refund will be issued and a new agency booking fee will be payable.

3.4 If The Client cancels a booking and has reserved and paid for any play packs, these can be transferred to a postponed date free of charge.

3.5 If the Nanny cancels the booking a replacement will be provided. If a replacement is not available a refund will be issued. A refund will not be issued where:

00000a/ There is an unresolvable dispute between the Nanny and The Client regarding the terms of the booking.
00000b/ The Nanny has cancelled due to adverse economic, social and environmental changes.
00000c/ Both The Nanny and The Client agrees to cancel the booking.

 4. General

4.1 The Agency has a minimum booking requirement of 4 hours per Nanny.

4.2 The Nanny/Nannies are required to work in accordance with The Agency and Ofsted’s minimum staffing ratios and as such reserve the right to refuse to care for additional children on the day, if this breaches the ratios.

4.3 The Agency endeavours to provide The Client with only the most suitable Nanny/Nannies. The Agency does not accept any liability for any kind of inconvenience, loss or damage however arising and whether caused directly or indirectly by The Nanny/Nannies.

4.4 No warranty is offered in respect of suitability, honesty, capability or character of The Nanny/Nannies introduced by The Agency.

4.5 The temporary Nanny/Nannies may work on a self-employed basis and hold their own public liability insurance which can be requested prior to the booking. If The Nanny/Nannies are not self-employed, it is the responsibility of The Client to set up temporary payroll for The Nanny/Nannies. The Agency takes no responsibility for payroll and Nanny payments which must be agreed directly between The Client and The Nanny/Nannies.

4.6 The Agency holds insurance for additional services provided to The Client by The Agency including and not restricted to toys, crafts, play tents and gifts. If these services are booked, insurance details will be provided on request 12 weeks prior to the booking date.

4.6 Once the booking is complete, The Client must inform the Agency if any further working relationship is to be established between The Client and The Nanny/Nannies. If The Client does not inform The Agency of such relationship, The Agency will charge a placement fee plus an additional 10% charge if express prior permission has not been gained in writing from The Agency.

4.7 It is the responsibility of The Client to inform The Agency in writing, at the time of booking if there are any special needs/requirements that the child/children may have/require so that The Agency can make the appropriate arrangements with The Nanny/Nannies involved. This is specifically important in the areas of health and or diet.

5. Confidentiality

5.1 All communication, whether written or verbal shall remain confidential between The Agency, The Client and The Nanny/Nannies.

These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales.

The Agency reserve the right to amend these terms and conditions without prior notice.
