Terms & Conditions and Agency Fees – Wedding & Event Childcare

INTERPRETATION: Any reference to “The Agency” is a reference to The Parent and Child Nanny Agency and any reference to “The Client” is a reference to the persons who have requested The Parent and Child Nanny Agency to introduce to the staff for employment by that person or persons on a temporary basis. Any reference to “The Wedding or Event Nanny” is a reference to any childcare professional introduced by The Parent and Child Nanny Agency.

1. Contract

1.1 The engagement or use of service by The Client is an acceptance by The Client of these terms and conditions and of The Agency fees and payment thereof as set out by The Agency. No variation of these terms is valid unless agreed in writing by both The Client and The Agency.

1.2 These terms and conditions shall represent a legally binding contract between The Client and The Agency.

1.3 The verbal or written instruction is given by The Client to The Agency in order to deliver wedding or event childcare by the Wedding or Event Nannies as per the instructions of The Client.

2. Fees and Refunds

2.1 An engagement takes place when The Client has completed The Agency booking form and related booking deposit payment.

2.2 The Agency will introduce the number of wedding or event nannies requested to The Client’s specified timings, as per the completed booking form.

2.3 A non-refundable booking fee is payable to secure the booking with The Agency.

2.4 a. The Client agrees to pay an hourly rate negotiated with The Agency directly to the Wedding or Event Nannies either on the day of the booking or seven days in advance of the booking along with a fuel charge of up to £15.00 per nanny per booking date. fuel charges are not included in the quoted amount as they may or may not be added. This does not apply to mobile crèche bookings.

2.4 b. Where a mobile crèche booking is made, The Client agrees to pay an all-inclusive payment that includes the crèche Event Nannies, the crèche manager and the crèche itself. 

2.5 Final confirmation of the number of children is required from The Client no later than eight weeks prior to the booking date. Any increase in numbers may require further Wedding or Event Nanny Introductions which will be charged immediately subject to availability. Any decrease in numbers will not be refunded.

2.6 The Client is solely responsible for paying the agreed wages of the Wedding or Event Nannies provided for the wedding or event. These amounts may increase or vary from the original quote if a. the agency invoice is not paid on time and the booking is presumed cancelled, b. the agency needs to confirm new nannies due to a lack of communication/booking fees left unpaid, c. the terms of the booking change or the hours/number of children increase.

2.7 Bookings commencing before 6:30 a.m., or ending after 12:30 a.m. incur additional Wedding or Event Nanny fees, unless overnight accommodation can be provided.

2.8 Any face-to-face meeting with the Wedding or Event Nanny prior to the booking date is chargeable and must be arranged via the agency.

2.9 A refund of 50% of any payments received in addition to the Agency booking deposit will be refunded subject to The Client providing at least 16 weeks’ notice of cancellation in writing.

3. Cancellations & Postponements

3.1 The Agency reserves the right to cancel the booking at any time. If The Agency cancels a confirmed booking due to a lack of availability, the related agency booking fees will be reimbursed in full. If The Agency cancels a confirmed booking due to a lack of information due to poor communication from The Client within 12 weeks of the booking date, the related agency booking fees may not be reimbursed.

3.2 If The Client cancels the confirmed booking for any reason including and not restricted to adverse economic, social, and environmental changes, The Agency booking deposit will not be refunded.

3.3 If The Client postpones the confirmed booking for any reason, the booking will be cancelled, no refund of booking fees will be issued and a new agency booking fee will be payable.

3.4 If The Client cancels a confirmed booking and has reserved and paid for any play package additions, these will be transferred to a postponed date free of charge.

3.5 If the Wedding or Event Nanny cancels the booking a replacement will be provided. If a replacement is not available a refund will be issued. A refund will not be issued where:

00000a/ There is an unresolvable dispute between the Event Nanny and The Client regarding the terms of the booking.
00000b/ The Event Nanny has been cancelled due to adverse economic, social, and environmental changes.
00000c/ Both The Event Nanny and The Client agree to cancel the booking.
………..d/ The booking was a free-of-charge transfer due to the Coronavirus pandemic and either The Client or The Wedding or Event Nanny cancels the booking and no replacement is available.

3.6 If The Client wishes to cancel a booking, this must be done in writing, or via the designated ‘ Cancel my Booking’ form. A link to this form will be sent on request. If The Client fails to inform The Agency of a cancellation, The Wedding or Event Nannies will request payment in full.

3.7 Wedding or Event Nanny booking fees are payable no later than 14 days prior to the booking. Failure to pay booking fees may result in cancellation of the booking and no refund of the booking deposit will be issued.

3.8 Agency booking fees are paid in two stages, 1. when making the booking and 2. when final booking details have been confirmed. Booking fees are payable immediately. If booking fees remain unpaid without reasonable communication, the booking will be cancelled after three reminders and the initial booking deposit will not be refunded.

 4. General

4.1 The Agency has a minimum booking requirement of 2 hours per Wedding or Event Nanny.

4.2 The Wedding or Event Nannies are required to work in accordance with The Agency and Ofsted’s minimum staffing ratios and as such reserve the right to refuse to care for additional children on the day if this breaches the ratios. The standard agency staffing ratio may be expanded under certain circumstances, however, the minimum ratio will always be in line with .gov and Ofsted’s minimum staffing ratios.

4.3 The Agency endeavours to provide The Client with only the most suitable Wedding or Event Nannies. The Agency does not accept any liability for any kind of inconvenience, loss or damage however arising and whether caused directly or indirectly by one of the Wedding or Event Nannies.

4.4 No warranty is offered with respect to the suitability, honesty, capability or character of any Wedding or Event Nannies introduced by The Agency.

4.5 The Wedding and Event Nannies work on a self-employed basis and hold their own public liability insurance which can be requested prior to the booking.

4.6 The Agency holds insurance for additional services provided to The Client by The Agency including and not restricted to toys, crafts, play tents and gifts. If these services are booked, insurance details will be provided on request 4 weeks prior to the booking date.

4.6 Once the booking is complete, The Client must inform the Agency if any further working relationship is to be established between The Client and The Event Nanny. If The Client does not inform The Agency of such a relationship, The Agency will charge a placement fee plus an additional 10% charge if express prior permission has not been gained in writing from The Agency.

4.7 It is the responsibility of The Client to inform The Agency in writing, at the time of booking if there are any special needs/requirements that the child/children may have/require so that The Agency can make the appropriate arrangements with the Wedding or Event Nannies involved. This is specifically important in the areas of health and or diet.

5. Confidentiality

5.1 All communication, whether written or verbal shall remain confidential between The Agency, The Client and The Wedding or Event Nannies.

These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Courts of England & Wales.

The Agency reserves the right to amend these terms and conditions without prior notice.
